A
Weatherford man, Anthony Rocky Garcia Jr., has been charged with
multiple felonies following a violent incident on December 4, 2024.
The charges, filed in Custer County District Court, include
kidnapping, burglary, assault, and violating a protective order.
Details
of the Case
According
to court documents, Garcia, 47, allegedly forced his way into the
home of the victim and confined her against her will. Prosecutors
claim he assaulted the victim, including strangulation and repeated
blows to her face, in violation of a court-issued protective order.
The
four charges against Garcia are as follows:
-
Kidnapping:
Garcia is accused of confining the victim in her home without her
consent. This felony carries a potential prison sentence of up to 20
years. -
First-Degree
Burglary: Prosecutors allege Garcia broke into the victim’s
residence with the intent to commit a crime. If convicted, he faces
7 to 20 years in prison. -
Domestic
Assault and Battery by Strangulation: Garcia is charged with
intentionally strangling and assaulting the victim, which carries a
penalty of 1 to 3 years in prison, a fine of up to $3,000, or both. -
Violation
of a Protective Order: The defendant allegedly disregarded a
final protective order issued in September 2023 by entering the
victim’s home and physically attacking her. This felony could
result in up to 5 years in prison and fines up to $5,000.
Prior
Convictions
Garcia’s
criminal history includes previous convictions in California. In
2018, he was sentenced to five years, with most of the time
suspended, for charges including violating a protective order and
assault with a dangerous weapon. Earlier that year, he served a brief
sentence for another protective order violation.
Ongoing
Legal Proceedings
Garcia
remains in custody while awaiting further court proceedings. The
case, filed under CF-2024-276, is being prosecuted by Custer County
District Attorney Angela C. Marsee. If convicted on the current
charges, Garcia could face decades in prison, compounded by enhanced
penalties due to his prior felony convictions.
