Riot Charges Handed Out to Custer Co. Inmates

Three inmates at the Custer County Jail face riot related charges after allegedly attempting to instigate a riot inside the jail last month.

According to a probable cause affidavit, the incident occurred on January 3 when 21-year-old Luis Fernandez of Rome, Georgia, 22-year-old Travis Jones, and 40-year-old Mitchell Spearman, both of Clinton, refused to return to their cells after a fight had broken out in the jail.

The affidavit stated that the trio attempted to vandalize the jail by dumping a large trash can full of water from the second floor down a stairway, throwing cleaning bottles, and also allegedly poured cleaning chemicals on themselves and on the floor.

With the aid of deploying pepper balls near the inmates, deputies were able to secure the inmates and place them in their cells. However, the affidavit said that Jones allegedly spit on one of the deputies and kicked him.

A short time later it was reported that the fire alarm to the building would sound and a large amount of water came out of Fernandez’s cell. Upon further inspection it was suspected that the inmate had broken off a fire sprinkler head.

Court records show that charges against the inmates were filed last week and showed that Jones was charged with riot after a former conviction, placing body fluid on a government employee, and assault. Fernandez also received a riot charge and was charged with malicious injury to property, while Spearman received a riot charge.
